OMOTAYO, J. A.    Lagos, NIGERIA    December 25, 2008
Thanks Mr. Ugochukwu Ejikeonye for your effort. The Constitutional provision is very clear on the issue of corruption and immunity. In no place has the Constitution stated that looters of the treasury must not be investigated. I have written about this issue many times.

The Constitution did not even mention "distraction" that has become a common issue of reference in articles and speeches in Nigeria today. The trouble is that most of us do not have our own copies of the Constitution. Even those who have refused to go through completely from the first page to the last. All they often do is to look at a section and quote it out of context.

Section 308 of the Constitution provides immunity against civil or criminal proceedings to president, vice president, governor and deputy governor on conditions;

First, before this section applies, the president, vice president, governor and deputy governor must be on oath. Any elected officer in this category who is not on oath is not covered by this provision.

Second, the oath specifically highlighted faithfulness, true allegiance and discharge of duties "always in the interest of the Sovereignty". It adds that "I will not allow my personal interest to influence my official conduct or my official decisions", unquote. Corruption is a violation of this oath and constitutes abreach of the immunity clause.

Third, Section 15, Subsection 5 emphasised that "The State shall abolish all corrupt practices and abuse of power". The State here refers to Nigeria. This provision does not exclude anyboby be you president, vice president, governor or deputy governor. It provides a total war on corruption and abuse of office without any excemption.

How will the State eradicate corruption if the president, vice president, governor and deputy governor can loot or kill anyone with impunity?

The issue is that we have a very corrupt, incompetent or lazy judiciary. Lawyers have known the weaknesses it our judicial system and have exploited same to the advantage of the looters.

It is the judiciary that is sick that has compounded our fight against corruption. A true leader must start his house cleaning exercise from the judiciary. Then looters will not have a safe haven.

It is the judiciary that makes America worthy of emulation in civil and criminal cases. They do not bend the laws to suit their polical sons, daughters, godfathers, etc.

There is no country in the world where the immunity clause is not entrenched in her constitution, even the US, UK, Russia, China, etc. Yet the clause does not cover any abuse of office in any democratic setting. In military setting, it does because the Constitution is always suspended.

God bless Nigeria.
