Ribadu to appear at code of conduct tribunal in june for non-declaration of assets
| May 01, 2009
The Code of conduct tribunal dismissed preliminary objections, to charges of non-declaration of assets, by Mallam Nuhu Ribadu, the former chairman of the Economic and Financial Crimes Commission (EFCC). The tribunal ordered Ribadu to appear before it in June to defend the charges of non-declaration of assets.

The judge dismissed Ribadu’s objection, saying that the argument that the tribunal was not properly constituted with two out of three members as required by law did not apply. She said the constitution of the Federal Republic of Nigeria allows two persons in a tribunal to form a quorum, just as three persons are allowed to sit in the Court of Appeal or five justices of the Supreme Court are allowed to sit on appeal.

She maintained that the tribunal was properly constituted with two out of three members and Ribadu would be tried for contravening the law.

Ribadu's second objection argued that the charge against him was incompetent because it was brought to the court long after he had left office and had been dismissed from the police. The tribunal chairman said once the provision of the code of conduct is contravened, it does not matter if the hewas out of office when the charge is preferred against him.

She maintained that the charge was triable and it would be tried and since Ribadu had always insisted that his assets were declared it would be in his interest to appear on June 10 at the next sitting of the court. And if he is absent on that date, she would order the prosecution to prove its case against Ribadu.
